Terms of Use

These Terms of Use ("Terms") govern your use of the Scale Diary mobile application ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

The App is also subject to Apple's Standard End User License Agreement (the "Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA prevails for App Store purchases.

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use. Your purchase covers the Apple ID used to buy the App and any Family Sharing members configured under that account.

The App stores entries you create — actions, categories, notes, and images — locally on your device. You retain full ownership of this content. We never access, transmit, or process it (see our Privacy Policy). You are solely responsible for backing up your content; deleting the App will permanently remove all locally stored entries.

4. Purchases and refunds

The App is sold as a one-time purchase through the Apple App Store. All sales are processed and managed by Apple. Refund requests must be submitted to Apple in accordance with their policies (typically via reportaproblem.apple.com). We cannot issue refunds directly.

5. Updates

We may release updates to the App that improve, modify, or change features. Updates are delivered through the App Store. Continued use of the App after an update constitutes acceptance of the update.

6. Disclaimer

The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise — including, but not limited to, warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Scale Diary is a personal reflection tool. It is not a medical, psychological, or therapeutic service and must not be used as a substitute for professional advice, diagnosis, or treatment. If you are experiencing a mental-health crisis, please contact a qualified professional or local emergency services.

7. Limitation of liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, consequential, special, or exemplary damages — including, but not limited to, loss of data, loss of profit, or loss of goodwill — arising from your use of, or inability to use, the App. The Developer's total aggregate liability for any claim arising out of or relating to the App shall not exceed the amount you paid for the App.

8. Intellectual property

The App, its name, logo, design, and all related materials are the property of the Developer and are protected by copyright, trademark, and other intellectual-property laws. No rights are granted to you other than the license expressly stated in these Terms.

9. Termination

These Terms remain in effect until terminated. They terminate automatically if you fail to comply with any provision. Upon termination, you must stop using the App and delete all copies from your devices. Sections 6, 7, and 8 survive any termination.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which the Developer is established, excluding its conflict-of-law rules. Disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless mandatory consumer-protection laws in your country of residence provide otherwise.

11. Changes to these Terms

We may revise these Terms from time to time. The current version will always be available at scalediary.app/terms.html. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
